Brandywine Deed, 1786

This is the third of the three Brandywine deeds, which became the Lea-Tatnall Mills. This document is being returned to the care of the Delaware Archives, 2011.

THIS INDENTURE made this tenth day of the third month one thousand seven Hundred and Eighty six BETWEEN John Lea of the Borough of Wilmington in the County of Newcastle upon Delaware Esq & Christiana his Wife of the one part and Isaac Starr of the same place Potter of the other part WHEREAS the sd John Lea by Virtue of an Indenture of Bargain and Sale duly Executed under the Hands and Seals of Francis Uday [?] and Mary his wife for the consideration therein mentioned became Seized in Fee of and in the following described Lot or piece of Pasture Ground Situate and being on North Wisterly side of Pasture Street in the said Borough and bounded as followeth (to wit) BEGINNING at a corner post on the side of Pasture Street at two Perches broad being also a Corner of Thomas Canby's now Harvey's Lot thence with the side of Pasture Street North thirty two degrees East about fourteen Perches to another corner post being also a Corner of a Lot late of Richard Carson's dec.d thence with the old line North thirty seven degrees West Seventy four perches to another Corner Post thence South five degrees East five perches & three tenths of a perch to a Poplar thence South four degrees West nine perches & seven tenths of a Perch to a white oak thence South thirteen degrees West six Perches to a Poplar thence South sixty three degrees East four Perches and eight tenths of a perch to a Corner Black Oak a Corner of the said Harvey pasture thence with the old line thereof South thirty seven degrees East fifty eight Perches to the place of Beginning and Containing within those Bounds four acres and One Hundred & thirty two Perches of land be the same more or less with the Appurtenances TO HOLD to the said John Lea his heirs & assigns forever UNDER & SUBJECT as in the said Indenture mentioned as by the said Indenture Resiting as is there line Resited bearing Date the Sixteenth day of the sixth Month A.D. 1760 and acknowledged in August Term one thousand seven Hundred and sixty one. Reference thereunto being had may more fully and at large appears NOW THIS INDENTURE WITNESSETH that the said John Lea and Christiana his wife for and in Consideration of the Sum of Five Hundred Pounds Gold and Silver Money to them in hand paid or Secured to be paid at or before the Sealing and delivery hereof by the said Isaac Starr the Recp. whereof they do hereby acknowledge and confess themselves therewith fully satisfied contented and paid and thereof and of and from every part and parcel thereof do release acquit Exonerate and forever discharge the said Isaac Starr his heirs and assigns by these Presents HAVE Granted Bargained and Sold aliened Released and Confirmed and by these Presents DO Grant Bargain and Sell Alien Release and Confirm unto the said Isaac Starr his Heirs and Assigns all that the above described Lot or piece of Land and Premisses Situate lying and being as afrsd and Containing within the meets and Bounds thereof four acres and One Hundred and Thirty two Perches of Land be the same more of Less TOGETHER with all and Singular the Fences Rights Liberties Priveledges Waters Water courses Ways, Easements and Appurtenances whatsoever thereunto belonging or in any wise appertaining and the Reversions Remainder Rents and Issues and all the Estate Right Titles Interest Properties Claim and Demand of the said John Lea Christiana his Wife and his Heirs of in and to the same and of in and to every part and parcel thereof WITH all Deeds Writings and Court Rolls touching or concerning the same and none in the Possession of the said Jno Lea TO HAVE AND TO HOLD all and Singular & the said Bargained Lot or piece of Land & Premisses unto the said Isaac Starr his Heirs and Assigns to the only proper Use Benefit and behoof of the said Isaac Starr his Heirs and Assigns forever Under the Yearly Quit Rents payable thereout to the chief Lord or Lords of the Fee and also Under Subject as in the afsd Indenture is mentioned AND the said John Lea for himself and for the said Christiana his Wife his Heirs Executors & Administrators and to and for each and every of them doth Covenant Promise and agree to and with the said Isaac Starr his Heirs Execrs Admrs & Assigns and to and with each & every of them by these presents in manner following (that is to say) that the said John Lea his Heirs Executors Administrators or some or one of them all and Singular that the above described Lot or piece of Land and Premisses hereby Bargained and Sold or mentioned as to be and every part and parcel thereof with every the appurtenances against the said John Lea and Christiana his Wife and his Heirs and against all and every other Person or persons whomsoever having or Claiming or that shall or may at any time hereafter Carefully Claim the same or any part or parcel by from or under them the said John Lea and Christiana his Wife or by from or under either of them unto the said Isaac ⇑Starr his Heirs and assigns shall and will WARRANT and forever DEFEND by these Presents IN WITNESS whereof they the said John Lea and Christiana his Wife have hereunto put their hands and seals and dated the day and Year first above written.
